Update to the BIM-MEP AUS Terms and Conditions

We have updated the Terms and Conditions that apply to BIM-MEP AUS subscriptions and to the use of this website. The updated Terms and Conditions are published here and take effect from 21 September 2026.

The changes bring the Terms and Conditions up to date and make five things clearer.

Who you are contracting with. The Terms and Conditions now state expressly that BIM-MEP AUS is an industry initiative of the Air Conditioning & Mechanical Contractors’ Association of Australia Limited (ABN 87 005 021 670) (AMCA), and that AMCA is the party you contract with when you take out a subscription. This has always been the position. It is now stated on the face of the document.

Subscription term and renewal. Subscriptions run for 12 months from the date access is provided, and expire at the end of that term unless they are renewed. Content you downloaded during an active subscription may continue to be used after your subscription expires — that has not changed. New and updated content can only be downloaded while a subscription is active.

Transfer of the agreement. AMCA may assign or novate your subscription agreement to a person who acquires the BIM-MEP AUS business or assets. If that happens, your subscription continues on the same terms with the new provider, and the fees you pay and the content and services you are entitled to receive do not change for the remainder of your current subscription term. We will notify you in writing before any transfer takes effect.

Privacy. The Terms and Conditions now include a privacy section, which sits alongside our Privacy Policy. It explains that your information may be handled by service providers who administer BIM-MEP AUS on our behalf, and that it may be disclosed to a prospective purchaser of the BIM-MEP AUS business — on a confidential basis and, wherever practicable, in de-identified form — and transferred to a purchaser on completion of such a purchase.

Liability. The Terms and Conditions now state expressly that nothing in them removes any right you have under the Australian Consumer Law that cannot be excluded. They also set a limit on the amount we can be liable for, and exclude indirect losses. The previous wording attempted to exclude all warranties, which the Australian Consumer Law does not allow.

Do you need to do anything? No. Your subscription and your access to BIM-MEP AUS content are unaffected.
