Introduction

By visiting, viewing or ordering from our website you agree to acknowledge and be bound by the Terms and Conditions outlined in this agreement.

This Agreement outlines the trading Terms and Conditions bound to all BIM-MEP AUS transactions incorporating but not limited to online, phone and email ordering. Furthermore, this agreement outlines specific terms of use applicable to all aspects of our website.

These Terms and Conditions apply to all BIM-MEP AUS subscriptions, including end-user subscriptions and manufacturer and supplier subscriptions, unless we have agreed separate written terms with you.

The words we, us, our, BIM-MEP AUS mean Air Conditioning & Mechanical Contractors’ Association of Australia Limited (ABN 87 005 021 670) (AMCA) of Suite 4, 255 Whitehorse Road, Balwyn VIC 3103, trading as BIM-MEP AUS. BIM-MEP AUS is an industry initiative of AMCA and is not a separate legal entity. The words the Site, our website and our Web Site mean the BIM-MEP AUS website at bimmepaus.com.au. The words “you” and “your” refer to registered users, customers, re-sellers, associates, suppliers or general public visitors to our Web Site. A person or organisation that holds an active BIM-MEP AUS subscription is also referred to in this Agreement as a Subscriber.

We may amend this Agreement at any time by posting the amended terms on our website. Any amendments to this document will be posted in the online News facility.

Except as stated below, an amended term takes effect when the amended terms are posted online. An amendment that materially affects your rights or obligations takes effect on the date stated in the notice of that amendment, which will be not less than fourteen (14) days after the later of the date the amended terms are posted and the date we send you notice of them.

Where an amendment materially affects your rights or obligations, we will also notify you by email at the address recorded for your subscription, and we will state in that notice the date on which the amendment takes effect. If an email notice to you is returned undelivered, we will take reasonable further steps to bring the amendment to your attention, using any other contact details we hold for you or for the organisation recorded for your subscription.

An amendment will not increase the fees payable for, or reduce the content or services provided during, a Subscription Term for which you have already paid.

This Agreement may not be otherwise amended except through a written request from you (signed) and agreed by us (signed). This agreement was last updated on 7 September 2026.

Governing Law

This Agreement is governed by the laws of the State of Victoria and of the Commonwealth of Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State and of the courts competent to hear appeals from them.

Intended Use

All material including but not limited to text, images, multimedia, advertisements and downloadable content is published by us and made available to worldwide audiences. If you access this website and the content within it, outside of Australia, you do so at your own risk and you must comply with the rules and regulations enforced by your respective jurisdiction.

You agree differing terms and conditions exist between local (Australian) and international customers.

The general public of all ages may view all publicly available material, however must not use or copy it for personal or any business related purposes, without the prior consent of BIM-MEP AUS.

Only registered BIM-MEP AUS users with an active BIM-MEP AUS subscription may download BIM-MEP AUS material for commercial purposes. Downloaded material may continue to be used after the users active BIM-MEP AUS subscription has expired, however they will not be able to download any new or updated content after their subscription expiry date.

Registered users may be, but not limited to the general public, employees or representatives of companies, associations, governments or any other corporate entity.

Each single BIM-MEP AUS subscription must be used by only one registered person. A single subscription is not permitted to be shared by two or more people and is not transferrable, except as permitted under the section “Transfer of this Agreement”. Additional users require an additional separate single login.

BIM-MEP AUS offers multiple subscription tiers to cater for individual, small, medium and large organisations.

Subscription Term and Renewal

Unless we agree otherwise with you in writing, each BIM-MEP AUS subscription is granted for a term of 12 months commencing on the date we provide you with access to BIM-MEP AUS content (Subscription Term).

A subscription expires at the end of its Subscription Term unless it is renewed. We may offer to renew your subscription for a further 12 months at the price then published or quoted. Payment of a renewal invoice constitutes a new agreement for the renewed term on the Terms and Conditions published on the Site at the date of that payment.

Either you or we may elect not to renew a subscription, by notice given to the other before the end of the then current Subscription Term. No reason is required for that election.

Consistent with the section “Intended Use” above, material downloaded during an active Subscription Term may continue to be used after the subscription expires, but no new or updated content may be downloaded after the expiry date.

We may suspend or terminate your subscription immediately, and without refund, if you breach a material term of this Agreement, including by sharing a single login with another person, copying or distributing BIM-MEP AUS material other than as permitted, or failing to pay an invoice by its due date. Nothing in this section limits any right or remedy you have that cannot lawfully be excluded.

Transfer of this Agreement

Assignment by us. We may assign, transfer or otherwise deal with all or any of our rights and benefits under this Agreement, in whole or in part, without your consent, including to a person who acquires the BIM-MEP AUS business, initiative or assets (a Transferee).

Novation. You agree that we may novate this Agreement to a Transferee, on not less than seven (7) days’ written notice to you, so that from the date the novation takes effect the Transferee holds our rights and assumes our obligations under this Agreement in our place, and we are released from those obligations. You consent in advance to that novation, and you agree that written notice from us to you identifying the Transferee and the effective date is sufficient to effect it. That notice may be given before this section takes effect, and may specify an effective date that falls on or after completion of the relevant acquisition.

On and from the effective date of an assignment or novation, this Agreement continues on the same terms between you and the Transferee, and every reference in this Agreement to us, we, our, BIM-MEP AUS or AMCA is to be read as a reference to the Transferee, to the extent of the rights assigned or the obligations assumed.

Further steps. You agree to promptly sign any document, and do anything else we reasonably require, to give effect to an assignment or novation under this section. We will bear our own costs and any reasonable costs you incur in doing so.

No change to your subscription. An assignment or novation under this section does not of itself change the fees payable by you, or the content and services you are entitled to receive, for the remainder of your then current Subscription Term.

Assignment by you. You may not assign, novate or otherwise transfer your rights or obligations under this Agreement without our prior written consent, which we will not unreasonably withhold.

Privacy and Personal Information

We collect, hold, use and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the BIM-MEP AUS Privacy Policy published on the Site, which forms part of this Agreement.

Service providers. You acknowledge that some or all of the commercial operations of BIM-MEP AUS, including subscriptions, billing, customer support and content delivery, may be administered by third-party service providers on our behalf, and that we may disclose your personal information to those providers for that purpose.

Sale or transfer of the BIM-MEP AUS business. You agree that we may disclose personal information about you and your personnel, including names, positions, business contact details, workplace, and subscription and transaction records:

(a)    to a prospective purchaser of the BIM-MEP AUS business, initiative or assets, and to that person’s professional advisers, for the purpose of assessing that acquisition — on a confidential basis and, wherever practicable, in de-identified or aggregated form; and

(b)   to a purchaser of the BIM-MEP AUS business, initiative or assets, on and from completion of that acquisition, for the purpose of continuing to provide the BIM-MEP AUS subscription, content and services to you.

Where we disclose personal information under this section, we will do so on a confidential basis and, wherever practicable, in de-identified or aggregated form — except for a transfer under paragraph (b) above, where identifiable information is necessary for the purchaser to continue providing the subscription, content and services to you.

We will also require the recipient to handle that information in accordance with the Privacy Act 1988 (Cth). We will notify you before any transfer under paragraph (b) above takes effect. You may contact us at bimmepaus@amca.com.au at any time with a question about, or an objection to, a disclosure under this section, and you may request access to or correction of your personal information in accordance with the Privacy Policy.

Subscribers outside Australia and New Zealand. If you are located in a jurisdiction whose data protection laws require your express consent to a disclosure of the kind described in this section — including the European Union and the United Kingdom — we will not make that disclosure in reliance on this section unless you have given that consent.

Disclaimer and Limitation of Liability

All material on our website is provided to you “as is” and “as available”. We do not warrant or guarantee the accuracy, adequacy or completeness of this material, and expressly disclaim liability for mistakes, misleading or absent information.

Subject to the paragraphs headed “Your rights that cannot be excluded”, “Where we may limit our liability” and “Limitation of our liability” below, and to the maximum extent permitted by law, we do not warrant, guarantee or make any representations or warranties of any kind, whether express, implied or statutory, in relation to the material on our website.

Your rights that cannot be excluded. Nothing in this Agreement excludes, restricts or modifies any guarantee, condition, warranty, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or by any other law, to the extent that it cannot lawfully be excluded, restricted or modified (Non-excludable Rights). If a term of this Agreement would have that effect, that term does not apply to you to that extent.

Where we may limit our liability. Where we are liable to you for a failure to comply with a guarantee under the Australian Consumer Law, and that guarantee relates to services of a kind not ordinarily acquired for personal, domestic or household use or consumption, our liability for that failure is limited, at our option, to supplying the services again or to paying the cost of having the services supplied again.

Limitation of our liability. Subject to your Non-excludable Rights, and to the maximum extent permitted by law: (a) we are not liable to you for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, however arising; and (b) our total liability to you for all claims arising out of or in connection with this Agreement or your use of the Site, whether in contract, tort (including negligence), under statute or otherwise, is limited in aggregate to the subscription fees you have paid to us for the Subscription Term in which the liability arose.

Subscription enquiries can be made by clicking the BIM-MEP AUS Subscribe link and completing the form to register for a new account, or by completing registration forms where appropriate for the relevant product or service. After completing a registration form, a BIM-MEP AUS team member will contact you via phone or email during business hours, to discuss the most appropriate subscription type and product or service for you. Ordering over the Internet enables customers to access pricing and information regarding our subscription types.

Any online orders are treated as an express intention to purchase the nominated goods (Purchase Order) for the agreed online prices.

We reserve the right to alter any agreed prices if an incorrect price was caused by a software fault, error or malicious attack.

Australian and New Zealand customers are billed using Australian dollars (AUS$).

All customers outside Australia and New Zealand are billed using US dollars (US$).

All listed prices displayed may or may not include GST or other taxes if applicable.

Tax will be applied at time of purchase if relevant to each customer’s local tax laws.

All prices are subject to changes without prior notice.

Order Process

In most cases, access to BIM-MEP AUS content will be processed and available within 72 hours unless otherwise advised. During trade fair and event periods, please expect a longer process and dispatch time.

Please call the AMCA on 1300 475 615 (Option 6) if you have not received access to content within 7 working days of placing your order or if you have any concerns regarding the order process.

Methods of Payment

For ordering online, we accept the following methods of payment:

• Secure credit card transactions for VISA and Mastercard
• A payment is considered complete when the funds have been cleared.

For offline payments we accept the following methods of payment:

On account:

• We only accept payment on account if you are a regular customer of BIM-MEP AUS. All account customers must fill out a credit application form prior to picking this option.

Governing Law

• The Terms and Conditions of this agreement are governed by the applicable statutory rules and regulations enforced by the Federal Government of Australia and the applicable State Government of the user purchasing the goods.
• For Australian and / or New Zealand based organisations that purchase a global subscription of BIM-MEP^AUS, to use the BIM-MEP^AUS products and services on Australian and / or New Zealand based projects, in office locations outside of Australia, must adhere to all the stipulations in these Terms and Conditions including but not limited to section “Intended Use”.

Intended Use
